1. Introduction

These General Terms and Conditions of Sale (the "Terms") govern purchases of cosmetic products made through the website https://www.cosmeticswan.com, owned by Tricoderma S.r.l.s., registered office at Via Nino Sansone 49, 72017 Ostuni (BR), Italy, VAT number 02780820748.

2. Scope

These Terms govern the distance selling of cosmetic products manufactured and distributed by Tricoderma S.r.l.s. to end consumers acting for purposes outside any business, commercial or professional activity they may carry out.

3. Acceptance of the Terms

By placing an order on the website, you accept these Terms in full. Please read them carefully before completing your purchase. The Terms may be amended; the applicable version is the one in force on the date the contract is concluded.

4. Registration and account

Creating an account is optional. You are responsible for the accuracy of the details you provide and for keeping your login credentials secure. Tricoderma S.r.l.s. is not liable for misuse of your account by third parties.

5. Products and availability

All products are described and presented accurately on the website. Slight differences in packaging or colour may nonetheless occur due to the settings of your device. Product availability is subject to stock, and Tricoderma S.r.l.s. reserves the right to modify or discontinue sales at any time.

6. Prices and payment

All prices shown are in euros and include VAT applicable at the time of the order. Shipping costs are calculated and displayed before you confirm your purchase. Payment can be made by credit card, PayPal, Apple Pay or other methods available at checkout. Payment is due at the time of the order; the charge is applied on confirmation.

7. Shipping and delivery

Orders are dispatched within 2 business days of confirmation. In Italy delivery takes 2-3 business days with Standard shipping and 1-2 with Express. For international destinations, times and costs are set out in our Shipping Policy. Delays not attributable to Tricoderma S.r.l.s. do not give rise to liability or to any right to compensation.

8. Right of withdrawal and returns

You have the right to withdraw from the contract within 14 days of receiving the products, as set out in our Refund Policy. For reasons of hygiene, we cannot accept returns of products that have been opened or used.

9. Legal guarantee of conformity

All products sold by Tricoderma S.r.l.s. are covered by the legal guarantee of conformity provided for by Articles 128-135 of the Italian Consumer Code. In the event of a defect, you are entitled to have conformity restored, free of charge, through replacement or refund.

10. Limitation of liability

Tricoderma S.r.l.s. shall not be liable for indirect, incidental or consequential damages arising from the use of, or inability to use, the website or the products purchased, save in cases of wilful misconduct or gross negligence.

11. Intellectual property

All content on the website, including text, images, trade marks and logos, is the exclusive property of Tricoderma S.r.l.s. and is protected by applicable copyright and industrial property law.

12. Governing law and jurisdiction

These Terms are governed by Italian law. Any dispute concerning the interpretation or performance of the contract shall fall within the exclusive jurisdiction of the court of the consumer's place of residence or domicile.
